ICE (Immigration and Customs Enforcement) has co-opted the criminal justice system and our local law enforcement agencies to achieve its immigration enforcement goals. One of the ways they are doing this is through the use of ICE detainer/hold requests.
One of our campaigns is dedicated to limiting the use of ICE Holds in McLean County.
What is an ICE Hold Request?
It is a request from ICE, that a local enforcement agency keep a person in custody for 48 hours longer after he or she is eligible for release. ICE holds are NOT:
Probable cause of a crime
Indication of undocumented or unlawful status
The equivalent of a judicial warrant
Evidence that a noncitizen has been deemed a danger to the community
So how do these requests work? Hold requests are ICE’s way of making sure that immigrants who end up in jail (regardless of how minor their crime, i.e. driving without a license) are kept there —even after they are legally free to go — so ICE can pick them up and use them to meet their deportation quotas (400,000 people per year!).
